Was the Transfer a Gift or Marriage Payment?
Settlement and Compromise Agreement
1. The parties, having consulted their respective legal counsel during the court-ordered adjournment, agree to resolve their dispute concerning the marriage payment (Mahr) on the following terms, intended to ensure fairness and equity and to accord with Sharia principles.
Acknowledgment of the Core Obligation
2. The parties reaffirm that the total Mahr stipulated in the marriage contract is 30,000 AFN. The Respondent acknowledges that this amount remains a binding legal and religious obligation.
Resolution of the Disputed Transfer
3. The parties acknowledge the ambiguity concerning the Respondent’s prior electronic transfer of 10,000 AFN to the Claimant. To resolve the dispute between the Respondent’s asserted intention to make a partial payment and the Claimant’s reliance on text communications that the transfer was for immediate emergency subsistence and expenses, the parties agree to divide the disputed amount equally:
a. 5,000 AFN shall be credited as a partial payment toward the outstanding Mahr; and
b. 5,000 AFN shall be treated as an absolute gift or subsistence allowance for immediate past living expenses and shall not be deducted from the Mahr.
Final Payment Terms and Schedule
4. Following the compromise in paragraph 3, the remaining Mahr balance payable by the Respondent to the Claimant is 25,000 AFN. The Respondent agrees to pay that balance according to the following schedule:
a. A lump sum of [Insert Amount, e.g., 10,000] AFN within [Insert Number, e.g., 7] days of the Judge signing this order; and
b. The remaining balance of [Insert Amount, e.g., 15,000] AFN in monthly installments of [Insert Amount] AFN, due on the first day of each calendar month until paid in full.
Mutual Release and Finality
5. Upon full performance of the payment schedule in paragraph 4, the Claimant releases the Respondent from any further financial claims concerning the Mahr.
6. The parties agree that this compromise is a full, fair, and final settlement of the immediate dispute and that they enter into it voluntarily and without duress.
