Judgment
Was the Rent Transfer Also Support?
1. Having considered the statements of both parties and the available evidence, the Court finds that the parties agreed to a household contribution of PHP 10,000 for June. Renato transferred PHP 4,000 directly to Lorna and made a separate payment of PHP 4,000 to her landlord, identified as June rent.
2. The evidence establishes that Lorna requested the rent payment because her landlord was asking about the rent. However, neither party has established that they expressly agreed the payment would be deducted from the PHP 10,000 contribution.
3. The Court acknowledges Renato’s argument that the rent payment benefited Lorna’s household expenses. Nevertheless, the fact that a payment benefited the household does not, by itself, establish that it fulfilled part of the specific contribution agreed upon. The parties’ messages and the payment record do not resolve this question in Renato’s favor.
4. Accordingly, the Court finds that Renato has not sufficiently established, on the present record, that the PHP 4,000 rent payment should be credited against the agreed contribution.
Order
5. Renato’s request to credit the PHP 4,000 rent payment against the PHP 10,000 contribution is denied on the evidence presented. The claim for PHP 6,000 in unpaid June support is granted, subject to any applicable legal requirements and any further evidence properly admitted by the Court.
So ordered.
