Judgment
Was the Remaining Maintenance Paid?
1. The Court has reviewed the signed maintenance arrangement, the text messages submitted in evidence, and the final testimony of both parties.
Findings
2. The signed arrangement requires a monthly maintenance payment of AFN 10,000 in cash. The Court acknowledges that Mr. Nadir Rahimi delivered groceries in apparent good faith. However, he produced no receipts establishing their monetary value.
3. The text messages show that Ms. Farzana Rahimi immediately objected to the substitution and did not consent to waiving the remaining cash balance.
Reasons
4. A unilateral substitution of goods for a binding cash obligation does not satisfy the contract. The Court therefore finds in favour of the plaintiff.
5. Ms. Farzana Rahimi refused to settle and made matters difficult for Mr. Nadir Rahimi. She is fined AFN 500, which will go directly to the state.
Order
6. Mr. Nadir Rahimi shall pay Ms. Farzana Rahimi the outstanding contractual balance of AFN 4,000 within 14 days of this order.
7. This matter is resolved, and the hearing is concluded.
