Judgment

Was the Household Support Paid?

Findings 1. The parties agreed to a monthly household contribution of AFN 6,000 during their period of separate living arrangements. 2. The Defendant sought credit for a cash payment of AFN 4,000 delivered through his brother. The receipt signed by the Plaintiff establishes that the cash was delivered but does not state its purpose. 3. The Plaintiff produced a verifiable WhatsApp exchange sent the evening before the payment. In that exchange, the Defendant stated that the AFN 4,000 was “for the heater.” The Plaintiff replied that the April household support remained separate. 4. When confronted with the exchange, the Defendant acknowledged that his prior recollection was mistaken and that, in light of his own message, he could not claim the payment was intended as household support. Reasons 5. The burden of proving that a particular payment discharged a known maintenance obligation rests on the payer where an alternative debt is asserted and supported by evidence. 6. The receipt is clarified by the Defendant’s explicit and uncontradicted message. The AFN 4,000 was reimbursement for the heater and cannot be counted again or retrospectively applied to the household maintenance obligation. 7. Accordingly, no part of the required AFN 6,000 household contribution was paid for April. Order 8. The Defendant’s request to credit the AFN 4,000 against household maintenance is denied. The payment is recognized as completed reimbursement for the heater. 9. The Defendant shall pay the Plaintiff, Farzana Rahimi, the outstanding April household contribution of AFN 6,000 within 14 days of this order. It is so ordered.
