Was the Household Support Already Paid?
1. Having heard the parties, I find Younes El Amrani guilty of failing to pay household support.
2. In her message of 4 April, Salma Bennani expressly stated that she expected Younes El Amrani to repay the loan on 5 April, specifying that it was separate from household support. Younes responded that he would send her MAD 2,000 on 5 April and would see to the rest on Sunday, without further clarification. On that basis, common sense dictates that he accepted to repay the loan on 5 April.
3. Younes El Amrani has no proof that the MAD 2,000 he sent was for household support rather than repayment of the loan. Accordingly, he has not yet paid household support.
