Picked up the cake, still won a refund: WhatsApp promise secures KSh 8,500
This decision was delivered in a fictional Legal Arena proceeding. It is not a real court judgment or legal advice.
A full judgment was not saved for this case. The original verdict summary is shown below.
The Court rules for the other side on liability and awards your side no relief from the refund claim. Wanjiku carried the burden under Rule 1 by identifying the KSh 8,500 deposit, the written WhatsApp exchange, and her position that the delivered cake was materially different from the agreed style. Under Rule 2 and Rule 37, that written chat is the clearest record of the promise before the Court. Your side did raise that the cake was collected without complaint and that a topper was offered before departure, but on this record that does not outweigh the written promise and the opposing account that she complained soon after collection. Applying Rule 39 and Rule 22, the record shows at most a limited attempted cure, not a proven cure that defeated the complaint, and the Court is not persuaded that acceptance at pickup alone bars the refund sought. Because the amount claimed is the surfaced deposit amount, the Court awards KSh 8,500.
