Judgment
The Transfer Before Separation
1. Grant shall produce the original contribution records, relevant messages, the recent memorandum, and confirmation of the transfer. The Court reserves its decision on whether the transfer represented a legitimate marital debt.
Remaining Joint Savings
2. Further unilateral withdrawals from the remaining joint savings are prohibited, except for specifically approved living expenses. Both parties shall cooperate with the bank.
Elise’s Request for $6,000
3. A limited initial release of funds is allowed, tied to documented immediate bills. The balance of Elise’s request shall be reconsidered after an accounting. The full $6,000 request is not adequately explained at this stage.
Monthly Maintenance
4. The amount of monthly maintenance, including Elise’s request for $1,800, shall be determined after obtaining evidence of Grant’s income and Elise’s net income and reasonable expenses. The Court would not deny all support solely because Elise is able-bodied.
Follow-Up
5. The parties shall provide the required documents by a short deadline, followed by a prompt review of temporary relief.
Reasons
6. The combination of the timing of the transfer, the lack of consultation, and a loan memorandum created shortly before the transfer raises the strongest concern about Grant’s conduct and warrants investigation. Those circumstances do not, by themselves, prove fraud or establish that the contribution was a gift.
7. The principal weakness in Elise’s request is her inability to explain the expenses or substantiate the committed business funds. However, her documented rent and evidence that her access to savings is restricted support addressing her immediate needs. The correction of the software error does not, by itself, make the remainder of her testimony false.
