v.Hamid RahmaniDefendant
Judgment
The Shop Sign That Was Not Collected
Findings
1. The original signed order required the defendant, Hamid Rahmani, to deliver the sign to the plaintiff’s shop in Kunduz by 12 May.
2. A written contract may be modified only by clear mutual agreement. The defendant admitted that there was no express agreement to change delivery to collection. A vague inquiry about workshop hours did not alter the written contract.
3. The sign was not delivered to the specified location by the agreed deadline. The defendant therefore breached the contract, notwithstanding his honest misunderstanding.
Order
1. Judgment is entered in favour of the plaintiff, Farid Naimi.
2. The defendant shall return the advance payment of 2,000 AFN to the plaintiff within 14 days of this order.
3. No further balance or payment is due from the plaintiff under this order.
4. The physical sign remains the property of the defendant, who may repurpose or resell its materials to mitigate his losses.
