The Mortgage Payment That Wasn't Support
Findings of Fact
1. This matter came before the Court for a hearing on temporary financial orders pending dissolution of the parties’ marriage. Having considered the parties’ representations, testimony, and submitted evidence, the Court finds as follows.
2. Informal communications, including text messages between the parties, indicate that Defendant Grant Mercer expressed an intent to contribute $1,200 per month toward “keeping the household going for now.”
3. Neither party presented a formal, legally binding contract or marital settlement agreement specifying how those funds were to be allocated among particular household expenses, including the mortgage, utilities, or storage fees.
4. During the disputed period, Defendant fulfilled his informal $1,200 monthly commitment by paying $800 directly to the mortgage lender to secure the marital home and transferring $400 directly to Plaintiff for other household expenses.
5. Plaintiff claims a shortfall for utilities, groceries, and a $180 monthly storage-unit fee. Defendant has assumed separate housing costs and currently pays $250 per month toward a separate personal debt.
Conclusions of Law
6. Because Defendant fulfilled his informal commitment of $1,200 per month through direct mortgage payments of $800 and direct transfers of $400, he is not in default of that undertaking. On the evidence presented, Plaintiff’s request for an additional $1,100 in back payments is without merit.
7. Temporary spousal support is intended to maintain reasonable financial stability during the pendency of divorce proceedings, balancing the recipient’s demonstrated need with the payor’s actual ability to pay.
Order
8. Plaintiff’s claim for $1,100 in retroactive household expenses is denied. Defendant shall receive full credit for the $800 direct mortgage payments and $400 direct transfers made toward his $1,200 monthly undertaking.
9. Defendant shall pay Plaintiff temporary spousal support of $450 per month, commencing on the first day of next month and continuing pending final financial disclosures and entry of a decree of dissolution.
10. Defendant shall continue making the direct monthly payment of $800 toward principal and interest on the mortgage for the marital residence to protect the marital asset pending final property division.
11. Plaintiff shall evaluate and take reasonable steps to mitigate optional monthly expenses, including storage-unit fees, or present an itemized inventory of the undivided marital property stored there at the final hearing.
