The Extra $400

1. The parties’ agreement is determined by the evidence presented, rather than by either party’s undisclosed subjective intention. On the evidence before me, I find that Ms. Bellamy’s interpretation of the $400 payment is better supported by the contemporaneous communications and transfer descriptions. 2. I find that the $400 payment labelled “move” was separate moving assistance and was not payment toward the $900 June maintenance obligation. The $500 payment labelled “June support” therefore leaves a balance of $400 outstanding. Order 3. Judgment is entered for the plaintiff, Nora Bellamy, in the amount of $400.
