Judgment
The Display That Arrived After the Opening
1. The defendant shall pay the expenses incurred by the plaintiff for renting the shelves. The defendant shall also pay an additional penalty of €50 for each day the shelves were late.
2. The plaintiff shall accept the shelves and shall not seek the return of the deposit paid to the contractor, in light of her statement that she still needed the shelves despite their late delivery.
Reasons
3. In the Court’s opinion, this is the most satisfactory conclusion available to both parties. The plaintiff receives the shelves and pays for them, while also receiving compensation for their late delivery.
4. The defendant receives compensation for the work performed, but must compensate the plaintiff for failing to comply with the initial agreement and must cover the resulting costs.
