Olomouc administrative court rejects challenge to parking penalty over unproduced payment proof
This decision was delivered in a fictional Legal Arena proceeding. It is not a real court judgment or legal advice.
Background
1. Lenka Doležalová, the plaintiff, asks the court to undo the Olomouc Regional Authority’s decision upholding a CZK 1,500 parking penalty and to return the matter for reconsideration. The authority asks the court to deny that request.
2. The dispute concerns whether parking payment for the plaintiff’s vehicle had completed by the 10:18 inspection. The plaintiff says a screenshot showed completed payment at 10:15. The screenshot itself is not among the presented exhibits. The authority’s final decision includes a reproduced inspection entry recording that no active payment was detected at 10:18.
Issues for determination
3. The first issue is whether the plaintiff has shown that payment was completed by 10:18, as needed to support her request for relief. Under the supplied claim-needs-proof and reliable-records rules, the plaintiff must support her request with specific facts or evidence; records such as timestamps generally carry more weight than unsupported descriptions.
4. The second issue is whether the authority’s decision has support in the inspection record. Under the supplied rule for agency decisions, the authority must be able to point to evidence in the record for its finding. The authority bears that burden here. The court also considers the supplied fairness rule concerning the quality of procedure, but the record contains no specific evidence of a procedural defect beyond the limits of the inspection extract.
Submissions of the parties
5. The plaintiff says that her client paid for parking and showed evidence, and later repeatedly describes a screenshot showing completed payment at 10:15, with the correct date, amount, place, and time. She argues that a slow or unreliable authority system, or a human mistake, could explain why the inspector did not see the payment. She asks the court to undo the penalty and return the matter for reconsideration.
6. The authority argues that the inspection entry records no active payment at 10:18. It acknowledges that the entry reports what the inspector detected and does not show the full payment history. It says the screenshot described by the plaintiff is not in the record and therefore cannot be assessed for its status, timestamp, or connection to the vehicle or parking session. The authority asks the court to deny the requested relief.
Evidence and findings
7. The final decision and inspection extract are presented as exhibits 2, 4, 6, and 8. They repeat the same entry: a 10:18 check in Olomouc and “no active payment” for the plaintiff’s vehicle. These are repeated presentations of the same described decision and entry, not four independent inspection records. The entry is relevant and supports the finding that the inspector recorded no active payment at that time. Its weight is limited: it does not describe the checking method or establish the complete payment history.
8. The plaintiff’s statements are evidence of what she claims, but they are not the screenshot or an independently verifiable payment record. The plaintiff’s description is consistent in asserting a 10:15 completion, but consistency alone does not permit the court to inspect the screenshot’s contents or confirm that it concerns this vehicle or parking session. The authority’s statements likewise do not add a separate record of the payment history; the authority candidly acknowledges that limitation.
9. The plaintiff’s suggestion that a slow system or a tired inspector may have caused an error is a possible explanation, not proof that payment had completed before the inspection. The record does not establish that the system was slow, that the inspector failed to notice a payment, or that payment was active at 10:18.
Reasons
10. On the payment-timing issue, the plaintiff bears the burden because she seeks relief from the penalty. The claimed 10:15 screenshot would be directly relevant, but it was not presented despite repeated opportunities to describe or provide it. The court cannot treat the plaintiff’s description of an unpresented document as though the document itself had been examined. The inspection entry, by contrast, is part of the presented decision and records no active payment at 10:18. It does not conclusively establish that no payment had ever been made, but it weighs against the plaintiff’s claim of timely completed payment. The plaintiff has therefore not proven this issue.
11. On record support, the authority has met its burden to the limited extent required by the supplied rule. The decision points to a specific inspection entry, at a specific time, recording no active payment for the vehicle. That is evidence supporting the authority’s stated finding. The entry’s limits matter, and the court does not find that it proves the full payment history or resolves every possible explanation. But the plaintiff’s unverified screenshot description does not establish that the authority’s recorded observation was wrong. The record also does not show a particular unfair procedure that would independently undermine the decision. This issue is established on the limited record presented.
12. The plaintiff’s request to return the matter for reconsideration does not cure the evidentiary gap. The court has considered the authority’s acknowledgment that the extract is not a complete payment history. That acknowledgment is appropriate, but it does not shift the plaintiff’s burden to support her request. No further adjournment is available, and the record provides no basis to postpone judgment in expectation of evidence that was not presented.
Final order
13. The plaintiff’s request to set aside the Olomouc Regional Authority’s decision and return the matter for reconsideration is denied. The authority’s decision upholding the CZK 1,500 penalty remains in place on this record.
14. No payment from the authority to the plaintiff is ordered. The court does not determine that the plaintiff never attempted payment; it determines only that the presented record does not prove completed payment by 10:18 or otherwise support the requested relief. The amount awarded to the plaintiff is CZK 0.
