1. Upon hearing the Applicant and the Respondent, in person or by counsel, and upon examining the electronic evidence submitted, including WhatsApp transmissions establishing a distinct personal loan agreement, the Court finds that the sum of $20,000.00 (Twenty Thousand Jamaican Dollars) previously paid by the Respondent was applied in satisfaction of a private personal loan. It cannot be set off against statutory maintenance obligations.
2. The Respondent is in arrears for maintenance for June 2026 in the amount of $20,000.00 (Twenty Thousand Jamaican Dollars).
